Terms of Service.

Pose Duel is made by Iris360 SA, Chemin Davel 14, 1009 Pully, Switzerland (“Iris360”, “we”). These terms cover two things: this website, including its early access list, and the Pose Duel service, the browser-based exercise game at poseduel.com with its paired-phone companion capture and related features (together, the “Service”).

By using this website, or by creating a Pose Duel account, you agree to these terms and to our Privacy Policy, which is part of the deal. If you don’t agree, please don’t use the Service.

These are beta terms. They will change as the Service evolves (Section 10).

1. This website and early access

Who early access is for

The early access form is for adults 18 or older. Use an email address you control.

The beta is for adults only. Minors cannot play during the beta, and a parent’s or coach’s early access request does not enroll anyone else. Family and team programs will come later, with their own terms.

What joining the list means

Joining the early access list records your interest and lets us contact you about availability and next steps. It is not a purchase, reservation, enrollment, or guarantee of a place or launch date. The form does not collect payment details. You can ask to leave the list at any time by emailing hello@poseduel.com.

Using this website

Please do not submit another person’s contact details without permission, send spam, attempt to disrupt the website, or misuse its forms. Product illustrations, characters, world previews, and any images or videos of people exercising are for illustration only. They may include concept imagery, do not guarantee the appearance or availability of every feature in the released experience, and do not show correct, safe, or recommended technique for any movement.

2. Beta status and availability

Pose Duel is currently in beta, by invitation. It will change, sometimes without notice. Features may appear, break, or be removed, and progress, scores, and cosmetic items may be reset. We aim for reliable service but promise no particular uptime, and we do not promise that any feature will remain available. We may suspend the Service for maintenance, security, or legal reasons.

3. Accounts: adults only

  • Accounts may only be created and used by an adult (the age of majority where you live, and at least 18). You are responsible for the physical play environment (clear floor, enough room, suitable footwear) and for keeping your credentials confidential.
  • Accounts are personal. Do not let anyone else, and never a minor, play on yours.
  • Use nicknames rather than full real names for display and hero names.
  • You must give accurate information and keep it current.

4. Not a medical device, no treatment claims

Pose Duel is a motivational game, not a medical product.

  • The Service provides general wellness, motivation, and gameplay feedback on exercise movements. It is not a medical device. It does not diagnose, treat, cure, mitigate, or prevent any disease or condition, and it provides no medical advice, physiotherapy, or therapy of any kind.
  • Our AI movement coach is a software feature, an AI, not a health professional. Its feedback concerns game scoring and general movement form only.
  • If a doctor, physiotherapist, or other qualified professional has given you exercises or restrictions, follow their instructions. Where anything in the Service conflicts with them, their advice wins. If an exercise causes pain, dizziness, or unusual discomfort, stop and consult a professional.
  • You confirm that you are physically able to do the chosen exercises. In-game safety reminders do not replace professional judgment.
  • References on this website to movements used in physical therapy or prehab do not promise prevention of an injury or a particular health or performance outcome.

5. Free during the beta

Pose Duel is in beta and is free to use for now. We reserve the right to change this later, for example by introducing paid plans or limits. If we do, we will tell account holders in advance (Section 10), nothing will be charged without your explicit agreement, and you will be able to stop using the Service before any change affects you.

6. Acceptable use

You must not:

  • let a minor, or anyone else, play on your account;
  • capture video of people who have not agreed to be in frame;
  • attempt to identify, harass, or contact other users, or upload unlawful, harmful, or infringing content anywhere the Service accepts input;
  • reverse engineer, scrape, probe, overload, or interfere with the Service or this website, bypass technical limits, or misuse the beta (for example automated play or spoofed pose data);
  • resell or commercially exploit the Service without our written agreement.

We may remove content, suspend, or restrict accounts to enforce this Section.

7. Intellectual property

  • The Service and this website, including code, game design, characters, artwork, music, sounds, models, and trademarks (including “Pose Duel”), belong to Iris360 or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for private, non-commercial use. Site branding, artwork, and product content are not offered for commercial reuse; contact us if you would like to use materials for your club, team, or publication.
  • Your data stays yours. Video, pose data, and other personal data are handled solely according to the Privacy Policy. Nothing in these terms grants us broader rights to it.
  • Feedback you send us (ideas, suggestions) may be used to improve the Service without obligation.

8. Warranty and liability

  • The Service is provided “as is” during the beta, without warranty of uninterrupted or error-free operation, to the extent permitted by law.
  • Nothing in these terms excludes or limits Iris360’s liability for unlawful intent or gross negligence (Art. 100 para. 1 Swiss Code of Obligations), for personal injury where liability may not lawfully be limited, or under mandatory product-liability law.
  • Subject to the above, Iris360’s liability for damage caused by slight negligence is excluded to the extent permitted by law. We are not liable for damage caused by ignoring professional instructions, unsafe play spaces, or use contrary to Section 4, nor for auxiliary persons to the extent Art. 101 of the Swiss Code of Obligations permits.
  • These limits apply to contractual and non-contractual claims alike, to the extent permitted by mandatory law. Mandatory consumer protections of your country of residence remain unaffected.

9. Termination

  • You may ask us to delete your account and data at any time, as described in the Privacy Policy. You may leave the early access list by email (Section 1).
  • We may suspend or terminate accounts for material breach of these terms or for legal reasons, and we may delete inactive accounts after notice. We may discontinue the beta or the Service with reasonable notice, by email where practicable.
  • Sections that by their nature survive (intellectual property, liability, governing law) survive termination.

10. Changes to these terms

We may update these terms as the website and the Service evolve. For material changes we will give reasonable notice, by email where practicable. If you disagree, stop using the Service; continued use after the change takes effect is acceptance.

11. Governing law and venue

These terms are governed by substantive Swiss law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive venue is Lausanne, Switzerland. Mandatory consumer-forum rules prevail where applicable.

12. Miscellaneous and contact

Should a provision be invalid, the rest remains in force and the invalid provision is replaced by the valid rule closest to its economic intent. You may not assign these terms without our consent; we may assign them to a successor of the business with notice. These terms plus the Privacy Policy are the entire agreement for the Service.
