PoseDuel Terms of Service (Draft)

Effective date: 26 July 2026 (beta) Provider: Iris360 SA, Chemin Davel 14, 1009 Pully, Switzerland ("Iris360", "we"). Service: PoseDuel, the browser-based exercise game at poseduel.com, including the paired-phone companion capture and related services (the "Service").
By creating an account you agree to these Terms and to the Privacy Policy, which is part of the deal. If you don't agree, don't use the Service.
1. Beta status and availability
PoseDuel is currently in beta, by invitation. It will change, sometimes without notice; features may appear, break, or be removed; progress, scores, and cosmetic items may be reset. We aim for reliable service but promise no particular uptime or that any feature will remain available. We may suspend the Service for maintenance, security, or legal reasons.
2. Accounts — parents hold them, children play
- Accounts may only be created by an adult with parental authority (or legal guardianship) over each child profile they add. You confirm you have that authority, and you complete our parental-verification and consent steps before a child can play.
- Children use PoseDuel through a parent-held account and under parental supervision. You are responsible for supervising your child's use, for the safety of the physical play space (clear floor, adequate room, appropriate footwear or supervision for barefoot play), and for keeping your credentials confidential.
- One account per family; child profiles should use nicknames, not full real names.
- You must give accurate information and keep it current.
3. Not a medical device — no treatment claims
PoseDuel is a motivational game, not a medical product.
- The Service provides general wellness, motivation, and gameplay feedback on exercise movements. It is not a medical device, does not diagnose, treat, cure, mitigate, or prevent any disease or condition, and provides no medical advice, physiotherapy, or therapy of any kind.
- Our AI movement coach is a software feature — an AI, not a physiotherapist or other health professional. Its feedback concerns game scoring and general movement form only.
- The exercises available in the Service must be ones your child's own physiotherapist or physician has prescribed or approved. Always follow your physiotherapist's instructions; where anything in the Service conflicts with them, your physiotherapist wins. If an exercise causes pain, dizziness, or unusual discomfort, stop and consult your clinician.
- You confirm your child is physically able to play as advised by their clinician. We may show in-game safety reminders, but they don't replace professional judgment.
4. Subscriptions and payment
During the beta the Service is free. When paid plans launch:
- Plans: Base and Premium, priced per child — differing in usage limits and features (e.g., session counts and depth of analysis). Current inclusions and prices: poseduel.com/pricing. Privacy settings are never a paid feature: every privacy mode is available on every plan.
- Billing is monthly, in advance, auto-renewing. Cancel anytime in account settings — cancellation is as easy as signing up, takes effect at the end of the paid period, and no reason is required. Statutory refund rights are unaffected; otherwise, part-months are not refunded.
- Prices may change; we'll notify you at least 30 days before a change affects you, and you can cancel before it does. VAT included where applicable.
5. Acceptable use
You (and your child) must not:
- use the Service for anyone without a valid parental relationship and consent;
- capture video of people who haven't agreed to be in frame;
- attempt to identify, harass, or contact other users; upload unlawful, harmful, or infringing content anywhere the Service accepts input;
- reverse engineer, scrape, probe, overload, or interfere with the Service, bypass technical limits, or misuse the beta (e.g., automated play, spoofed pose data — outside sanctioned developer/replay tooling we operate ourselves);
- resell or commercially exploit the Service without our written agreement.
We may remove content, suspend, or restrict accounts to enforce this Section.
6. Intellectual property
- The Service — code, game design, characters, artwork, music, sounds, models, and trademarks (including "PoseDuel") — belongs to Iris360 or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your family's private, non-commercial use.
- Your data stays yours. Video, pose data, and other personal data are handled solely per the Privacy Policy and your chosen privacy mode — nothing in these Terms grants us broader rights to it.
- Feedback you send us (ideas, suggestions) may be used to improve the Service without obligation.
7. Warranty and liability
- The Service is provided "as is" during beta, without warranty of uninterrupted or error-free operation, to the extent permitted by law.
- Nothing in these Terms excludes or limits Iris360's liability for unlawful intent or gross negligence (Art. 100 para. 1 Swiss Code of Obligations), for personal injury where liability may not lawfully be limited, or under mandatory product- liability law.
- Subject to the above, Iris360's total liability for damage caused by slight negligence is excluded, and in any event limited to the amounts you paid us in the 12 months before the event. We are not liable for damage caused by ignoring clinician instructions, unsafe play spaces, or use contrary to Section 3, nor for auxiliary persons to the extent Art. 101 CO permits.
- These limits apply to contractual and non-contractual claims alike, to the extent permitted by mandatory law (including mandatory consumer protections of your country of residence, which remain unaffected).
8. Termination
- You: delete the account anytime in settings; data is deleted per the Privacy Policy.
- We: may suspend or terminate accounts for material breach of these Terms, legal requirements, or extended non-use (12+ months, with prior notice), or discontinue the beta/Service with reasonable notice (30 days where practicable). If we terminate a paid subscription without cause, we refund the unused period pro rata.
- Sections that by nature survive (IP, liability, governing law) survive termination.
9. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we'll notify account holders by email at least 30 days in advance; if you don't agree, cancel before the change takes effect — continued use after that date is acceptance.
10. Governing law and venue
These Terms are governed by substantive Swiss law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive venue is Lausanne, Switzerland — subject to mandatory consumer-forum rules that give consumers the courts of their domicile (e.g., Lugano Convention Arts. 15–17 for EU-resident consumers; Swiss CPC Art. 32), which prevail where applicable.
11. Miscellaneous
Should a provision be invalid, the rest remains in force and the invalid provision is replaced by the valid rule closest to its economic intent. No assignment by you without our consent; we may assign to a successor of the business with notice. These Terms plus the Privacy Policy are the entire agreement for the Service.
